Telemedicine has inherent clinical and technological limitations compared to in-person care. Consultations conducted through the Platform are subject to constraints including, but not limited to, internet connectivity, device quality, inability to perform physical examinations, and limitations of remote diagnostic tools.

The licensed practitioners on our Platform exercise their independent professional judgment. MedixDeck makes no warranty as to the outcomes of any consultation, diagnosis, prescription, or treatment recommendation made by a practitioner through the Platform.

Practitioners may, at their sole clinical discretion, recommend an in-person visit where telemedicine is deemed clinically insufficient. MedixDeck shall not be liable for any adverse outcomes arising from a user's failure to follow such a recommendation.

Prescriptions issued on the Platform are subject to applicable Nigerian pharmaceutical regulations and the independent judgment of the prescribing physician. MedixDeck does not guarantee the dispensing, availability, or efficacy of any prescribed medication.

Your use of the Platform does not create a doctor-patient relationship between you and MedixDeck. Any doctor-patient relationship formed through the Platform exists solely between you and the individual licensed practitioner you consult.

MedixDeck facilitates the technical infrastructure for consultations but is not a party to, and does not supervise, the clinical decisions made by independent practitioners registered on the Platform.

MedixDeck does not employ the medical practitioners listed on its Platform. Practitioners are independent professionals registered on the Platform and are solely responsible for their clinical decisions, diagnoses, and advice.

MedixDeck operates in compliance with applicable Nigerian laws and regulations, including but not limited to: the Nigeria Data Protection Act (NDPA) 2023, the Medical and Dental Practitioners Act (Cap. M8 LFN 2004), the National Health Act 2014, the Telemedicine and Digital Health Policy of the Federal Ministry of Health, and the Consumer Protection Council Act.

MedixDeck implements a rigorous verification process and ensures that all practitioners on the Platform hold valid, up-to-date registration and licenses with the Medical and Dental Council of Nigeria (MDCN) and maintain appropriate professional indemnity insurance before they are permitted to provide services. However, users are still welcome to verify a practitioner's credentials independently if they so choose.

Content provided on the Platform does not represent the official position of the Federal Ministry of Health of Nigeria, the MDCN, or any other regulatory authority.

The Platform may contain links to third-party websites, resources, or services. Such external links are provided solely for your convenience and are not investigated, monitored, or endorsed by MedixDeck for accuracy, adequacy, validity, reliability, availability, or completeness.

Nothing in this Disclaimer shall limit or exclude liability for death or personal injury caused by MedixDeck's proven negligence, or for fraud or fraudulent misrepresentation, to the extent such limitation is prohibited by law.

Where liability cannot be excluded under Nigerian law, our aggregate liability to you for any and all claims arising from or in connection with the Platform shall not exceed the total fees paid by you to MedixDeck in the three (3) months immediately preceding the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless MedixDeck Health Solutions Ltd and its licensors, service providers, employees, agents, officers, directors, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of this Disclaimer or any applicable law, or your use of the Platform in a manner not expressly authorised herein.

This Disclaimer and all disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

Any dispute, controversy, or claim arising out of or relating to this Disclaimer that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Federal High Court of Nigeria or the State High Court of the Federal Capital Territory, Abuja.

You agree that any legal proceeding against MedixDeck must be filed within one (1) year of the event giving rise to the claim, to the extent permitted by applicable law.

MedixDeck reserves the right to amend this Disclaimer at any time. Material changes will be communicated via a prominent notice on the Platform or by email to registered users at least fourteen (14) days before the amended Disclaimer takes effect.
